La Fundación guifi.net denunciamos a los servicios territoriales de Girona y al Gobierno de España por detenernos despliegues de fibra óptica en pueblos pequeños, incumpliendo las normativas europeas, ralentizando el desarrollo de la Internet de alta velocidad y favoreciendo los oligopolios de las telecomunicaciones.
La última semana de noviembre de 2017, los Servicios Territoriales de Girona dieron orden de paralizar el despliegue de fibra óptica entre Aiguaviva y Vilobí d'Onyar y abrieron un expediente sancionador a nuestra Fundación argumentando que el despliegue no estaba autorizado cuando, en aplicación de las normativas europeas, las que conocen perfectamente, debería estarlo.
La aplicación de las directivas europeas es responsabilidad del Gobierno de España y, más concretamente, la responsabilidad de la aplicación de la directiva 2014/61 / CE recae en el Ministerio de Energía, Turismo y Agenda Digital del Gobierno de España, ya que sirve, entre otras cosas, para cumplir la Agenda Digital, facilitando los despliegues y reducir su coste simplificando las autorizaciones. Actualmente, a resultas de la aplicación del artículo 155 de la Constitución, los Servicios Territoriales de Girona también dependen del Gobierno de España.
Desde la Fundación guifi · net hemos intentado ponernos en contacto para tratar estos asuntos, pero sin ningún éxito. Además, de hecho, el incumplimiento de esta normativa es generalizado en el ámbito de cualquier administración española.Sobre estos asuntos, sólo el Parlamento Europeo nos ha contestado a nuestras peticiones. En respuesta nos han confirmado que debe ser de aplicación la nueva normativa. También nos animan a denunciar cuando creamos que incumplen nuestros derechos, lo que hemos hecho en primera instancia y sin perjuicio de que, si es necesario, más adelante también acudamos a otros tribunales y ante la Comisión Nacional de los Mercados y la Competencia (CNMC).
La Fundación guifi · net es una entidad sin ánimo de lucro que tiene por objetivo la llegada de Internet a todo el mundo a través de una red abierta, libre y neutral como bien común. Para ello, nuestra vocación es la de colaborar con las administraciones. Desde siempre lo hemos hecho, principalmente con Ayuntamientos pequeños, en tanto que compartimos objetivos. Por eso lamentamos que en ocasiones nos encontramos con administraciones que en vez de colaborar, ponen inconvenientes, y aún más cuando lo hacen saltándose la normativa vigente.
